Biden Advisors Used Temporary Protected Status to Build a Deportation Shield Against Trump
The internal presidential memo came from Biden’s lame-duck White House in January 2025, drafted by senior advisors who knew exactly what they were doing.
Schmitt, chairman of the Senate Judiciary Subcommittee on the Constitution, obtained it directly from Archivist of the United States Edward Forst.
The memo recommended Biden expand Temporary Protected Status to more than 3.1 million additional illegal aliens before Trump’s inauguration.
The target list read like a border crisis inventory: 1.5 million Guatemalans, 600,000 Ecuadorians, 464,000 Nicaraguans, and 455,000 Venezuelans – with the Venezuela redesignation opening the door for Tren de Aragua gang members to claim federal protection from deportation.
The memo stated the goal was shielding illegal aliens from “President-elect Trump’s planned mass deportations.”
A defeated president, in his final days, directing his staff to obstruct the immigration mandate Americans had just delivered at the ballot box.
“Biden tried to turn TPS into a 3.1-million-person deportation shield, protect Tren de Aragua members, and trap President Trump in years of litigation,” Schmitt told Fox News Digital.
The advisors knew the legal strategy cold.
The memo acknowledged that courts had blocked Trump’s first-term TPS rollbacks – but conceded those cases succeeded largely because his administration had failed to build a sufficient factual record.
Biden’s team viewed that as a correctable mistake and planned accordingly.
They weren’t just extending TPS. They were engineering a paper trail designed to make future terminations as legally painful as possible.
Eight Senate Democrats Pushed Biden to Grant Mass Amnesty to 3.1 Million Illegal Aliens
Biden’s senior advisors didn’t act alone.
Eight Democrat senators lobbied the outgoing president to expand TPS before Trump took office: Michael Bennet of Colorado, Catherine Cortez-Masto of Nevada, Cory Booker of New Jersey, Richard Durbin of Illinois, Mazie Hirono of Hawaii, Ben Ray Lujan of New Mexico, Tammy Duckworth of Illinois, and Alex Padilla of California.
They wanted new country designations – specifically Ecuador and Guatemala – added to an already bloated program.
Biden’s advisors pushed him to create 2.1 million new TPS designees in his final weeks, with the application backlog guaranteed to land on Trump’s desk.
“The most disturbing part, Biden’s ‘Senior Advisors’ recommended he create 2.1 million NEW TPS designees in the last few weeks of his presidency, despite admitting TPS applications take 6 months,” Schmitt said.
Biden’s team didn’t write policy. They built a bomb made of paper.
Biden did act on part of the memo’s recommendations – one week after it was transmitted, he extended TPS protections for nearly one million illegal aliens.
He couldn’t finish the job before January 20. That didn’t stop him from starting it.
Supreme Court Ruled 6 to 3 and Handed Trump the Authority to Finish the Job
Schmitt took to the Senate floor to explain how the scam works: Washington declares a foreign emergency, grants temporary status, watches the crisis fade, extends the status anyway, and resets the clock until “temporary” stops meaning anything at all.
Biden’s team counted on federal courts to keep that clock running indefinitely.
The Supreme Court pulled the plug. In a 6-3 ruling on June 25, the court’s conservative majority held that TPS terminations cannot be reviewed by federal courts – period.
Justice Samuel Alito, writing for the majority, ruled that the TPS statute “plainly bars” judicial review of how the president exercises that authority.
Every lawsuit Democrats planned to file, every injunction Biden’s advisors counted on – gone.
“This was mass amnesty-by-decree,” Schmitt said. “America is for Americans, and it is our home – it is not a permanent refugee camp.”
Biden’s advisors constructed a meticulous legal trap. They forgot to check who it would catch.
The memo sits in the Archives now, Biden’s intent documented in his own advisors’ handwriting – and the Supreme Court just gave Trump everything he needs to finish the job.
