Kellogg’s Kashi Brand to Pay $4 Million over “All Natural” False Advertising Lawsuit

KashiChristina Sarich – Kashi will pay $4 million in a false advertising lawsuit put forth in Florida. The lawsuit claimed that Kellogg’s, the parent company for Kashi, advertised an “all natural” (GM-free) product that was, in reality, full of genetically modified ingredients.

The settlement resolves a class action lawsuit against the company alleging that its products were falsely labeled as being “all natural” and containing “nothing artificial,” suggesting that they were free of genetically modified organisms.

Multiple Kashi products contain GM soy and GM corn, and a district judge argued that this “sufficiently alleges that a reasonable consumer would expect a product labeled ‘all natural’ to be free of GMOs.”

Kashi is also paying for a similar settlement in California:

“In a settlement filed in the southern district of California on May 2, Kashi said it would pay $5m to resolve a class action lawsuit accusing it of falsely advertising scores of products from GoLean bars to Kashi Pita Crisps as ‘all natural’ or with ‘nothing artificial’ when they in fact contained one or more of ‘an array of chemicals’ which the plaintiffs argued a reasonable consumer would consider unnatural”

This is an enormous win considering that the DARK act, which would prohibit states from instituting GM bans or GM labeling, has almost become law. It also is a testament to the changing tide in consumer’s attitude toward Big Food. Not only are citizens saying they want their food labeled, but they will no longer sit idly by while companies like Kellogg’s (or Pepsi, General Mills, etc.) lie about what is in food products. Independent Lab Confirms Kashi Go Lean Cereal Loaded With Toxic Glyphosate

Christina Sarich – An independent lab has found that Kashi’s ‘healthy’ GoLean Original breakfast cereal (owned by Kellogg’s) is loaded with the herbicide chemical glyphosate. What’s more, it actually contains 6x the amount of glyphosate previously found in Kellogg’s’ Froot Loops cereal.

The Kashi brand has been in trouble before. The company has faced multiple class action lawsuits when consumers accused Kellogg’s of misleading them with “natural” labels despite their cereals containing things like pyridoxine hydrochloride, calcium pantothenate, and hexane-processed soy oil.

Now, GMOFreeUSA.org is reporting that a box of Kashi Go Lean Original Cereal, which was not verified by the GMO Free Project, was sent to a lab to be tested for probably-carcinogenic glyphosate – the main ingredient in Monsanto’s best-selling Round Up.

The results were quite shocking:

“A glyphosate residue test was conducted by an accredited lab using the Specific LC/MS/MS testing method with a minimum detectable level of 0.02 ppm. The test documented the presence of glyphosate in the box of Kashi GoLean Original which was not verified by the Non-GMO Project, at a level of 0.68 ppm, or 0.68 mg/kg. This level is nearly 6 times higher than the levels detected in the independent testing we commissioned on Froot Loops.

The test also documented the presence of AMPA (aminomethylphosphonic acid), a metabolite of glyphosate, at an even higher level of 0.81ppm or 0.81mg/kg. This is the first time the lab has documented the presence of AMPA in the products we’ve had tested. The test results give significant reason for concern. KashiWhat does “natural” mean to you? If you’re like most people who see an “all natural” label on a food product, you would surmise that all of the ingredients are natural, not concocted in a lab or subject to man-made chemical processing. Unfortunately, in the world of processed foods, you can’t always judge a box by its labels

Recently Kellogg, the largest U.S. breakfast cereal manufacturer, offered to settle a class action consumer fraud lawsuit regarding their Kashi and Bear Naked cereal brands. At issue, labels that claimed the cereals were “All Natural” and “100% Natural”.

This lawsuit is one example of many where consumers are not just asking for transparency in their food choices, but demanding it and holding food-makers to task.

In this case, consumers accused Kellogg’s of misleading them with “natural” labels despite their cereals containing things like pyroxidine hydrochloride, calcium pantothenate, and hexane-processed soy oil.

The settlement agreement says that Kellogg’s agrees to remove the claims from their cereal labels but stops short of them admitting any misleading or fraudulent claims. It will also set up a $5 million fund for cash compensation to Kashi victims, at an average of $0.50 per box of cereal purchased during specific time periods. A separate Bear Naked fund of $325,000 will also be set up. Continue reading
